Sandwich thrown by protester supposedly burst and left condiment mark on border agent, court hears
A US immigration agent has declared in court he could sense through his protective gear the collision of a food product launched at him by a Washington DC protester, who has gone on trial for criminal charge.
Immigration and customs agent the officer told the court panel the sandwich "burst all over him" and he "could smell the vegetables and yellow sauce" on his uniform.
Both legal teams challenges that the accused, thirty-seven, did in fact hurl obscenities and a made-to-order snack at law enforcement deployed by the administration to monitor the Washington DC in the summer month.
The occurrence was filmed on video and spread across the internet, making Mr Dunn a representation of dissent in the federal district to the former president.
State lawyers at first tried to secure major offense allegations against the accused, but a legal panel refused to charge him.
The administration's assignment of armed forces to Washington DC this summer caused protest from some of the local inhabitants, who viewed it as a politicisation of the military.
Based on legal filings, the accused came near a police contingent at about late evening on the summer date, describing them "authoritarians" and exclaiming: "What is your purpose? Your presence is unwanted in my city!"
The legal proceeding witnessed a reenactment from the officer on the trial day as he took the stand against the defendant.
"I detected it through my protective gear," he said of the sandwich's impact, noting that an vegetable piece dangled from his police radio and condiment stained his uniform.
The defendant's legal counsel, the defense attorney, argued in her opening statement that throwing the deli product was a "innocent action that did not, could not, cause injury".
But prosecutor the state's representative argued the accused must be considered responsible.
"Whatever your status, you can't just go around hurling objects at others because you're mad," the prosecutor stated.
Subsequent to the claimed attack was revealed, Mr Dunn was dismissed from his employment as a paralegal in the government law department.
